What you’re responsible for

Three dates for every worker, and any one of them can catch you out

  1. NISCC registration within six months

    Staff new to social care must apply to the Northern Ireland Social Care Council when they take up the post and be registered within six months. You're responsible for making sure they are, and that they keep their registration and training (PRTL) up to date.

  2. AccessNI checks you can show

    RQIA expects an AccessNI check on file for every worker. Holding it isn't enough if you can't find it, or show when it was done.

  3. Right to work, before permission ends

    Staff with time-limited permission need a new check on or before the date it ends. Miss it and you lose your defence against a civil penalty of up to £60,000 per worker, starting at £45,000 for a first breach. The same law applies across the UK.

Most services have all of this on file. What catches them out is the date nobody was watching.

Questions

Questions from care services in Northern Ireland

Do you check the NISCC register for us?
No. We hold each worker's NISCC registration number and renewal date, remind the worker before anything is due, and tell you if they don't respond. Confirming a registration on the register itself stays with you. Right to work is different: we run that check on gov.uk for you.
How do you handle new starters who aren't registered yet?
Record their start date and we count the six months from it. The worker is reminded to apply, and you're told well before the deadline if they still aren't registered.
Is right to work any different outside England?
No. Right to work is UK immigration law, so the check, the share code and the penalties are the same in every nation. What differs is the regulator that inspects your records and the register your staff belong to, which is why this page talks about both.
Do we have to replace our spreadsheet or HR system?
No. Upload the spreadsheet you already keep, or an export from your HR or rota system. We match the columns, and the register starts from the dates you already hold.
Does it cover agency and bank staff?
Yes. They sit on the same register as your employed staff, and you log the evidence an agency sends against each worker, with the date it arrived.
Can we cancel?
Yes, at any time, from inside the product. There's no minimum term, and you can export your full record history whenever you like.
